The Film Precious by Lee Daniels Essay - 1002 Words

When you think of the word â€Å"poverty† or â€Å"poor† what comes to mind? Some think of hunger, minorities, dirty areas, women, and homeless people. What about when you hear the term â€Å"abuse†? For most people, abuse means physical; getting beat up or hit. Although abuse can mean getting beat up or hit, there is far more that follows. Abuse can take on many forms like physical, emotional or sexual. The film Precious by Lee Daniels, based on the novel Push by Sapphire, encounters not only the obvious sexual abuse but physical and emotional abuse as well. Precious starts off with Claireece Precious Jones, played by Gabourey Sidibe, at her school in Harlem. She is called to the office because the principal has found out she is pregnant†¦Again. Kicked†¦show more content†¦These stereotypes are very disadvantaging to the African American race because they are putting out messages that you have to look a certain way to be attractive. Although this film is disadvantaging to many people, it is also very beneficial. I think people that come from the lower class or an abusive household can really benefit from this film. The main point of this film is to show people that you can achieve anything you want to do no matter what background you come from, and although it might be hard because of economical/ personal issues you are not less of a person than anyone and you can still be successful. I love the idea of success because it doesn’t really have a set definition. You don’t necessarily need money to be/feel successful. You can work at Subway and still be successful while a twelve time Oscar winning actor can be successful. You sort of carve out your own success and make your own definition for it. This movie will also teach people that they are not on their own. Although you might think nobody is there for you, when you enter a room you don’t know what everyone is thinking or how everyone feels; you might now even know everyone. Disease, particularly the plague, was the most important factor in determining medieval, and/or early modern population levels, discuss. There were many different factors which contributed to the rise and fall of population levels during the medieval and early modern period. No doubt one of the most catastrophically devastating limitations to the population on record in the medieval times was that of the Black Death in 1348 to 1350. However, famines were another common cause of population decline, and because of their impact on fertility, it could be argued that they were an even bigger check on population growth than mass deaths from disease in the same period. Question: Describe about a Report of The boundaries of the Criminal Law? Answer: Introduction Under the English Legal System, non-fatal offences against the person are defined to be such attacks which a person is subjected to, not leading to the death of the person concerned. No fatal offences have been dealt with under the Offences against the Person Act, 1861. The Law Commission has widely criticized the non-fatal offences against the persons. The main points of criticism were; that the language that has been used in the said legislation is obscure, complicated and outdated; that the offence have not been properly structured and also that Sections 18, 20 and 47 must be repealed, and new provisions must be introduced. In the paper Law Commission Reform of Offences against the Person: A Scoping Paper, the Law Commission has examined the present law and the problems associated therewith. Apart from analyzing the issues, this paper also provides suggestions for future reforms. The purpose behind this paper is to make the law suitable for the 21st century. Primarily this paper h as insisted on creating a structured hierarchy of the offences and also simplifying the language of the statute. In this paper, we will analyze and discuss the suitability of the present laws dealing with non-fatal offences against the person. Language From my analysis, I would say that The Offences against the Persons Act, 1861 (also referred to as the Act) has not clearly provided the definitions of important phrases and words which have been derived their meaning primarily from case laws over the years. Maliciously The courts are giving different meanings to the terms every time they have to interpret its meaning. This has lead to a lack of proper decision making. For instance, in both sections 18 and 20 the term maliciously' has been used but the said term has not been defined in the Act. In the case of Cunningham, 1957 the courts have interpreted maliciously' as meaning recklessly' which happens to be an extension of the modern meaning of the term, i.e., bad intention. The term maliciously' under Section 20 means mens rea. However, this meaning of the term becomes unnecessary when applied to the provisions of Section 20 as mens rea with intention. Assault and Battery The terms assault' and battery' ought to have been all the more clear and unambiguous because these terms are the elements of various other offences. But great confusion arises as to the precise meaning of the term assault' as the statute uses the term common assault'. This is an inclusive term and includes the definitions of both, assault and battery. Thus, there is no clear and precise definition of the terms assault' and battery' despite being an important term of the statute. Inflict' and Cause' These two terms have been used quite a number of times in the statute. For instance, under Section 20 the phrase used is inflict any grievous bodily harm' whereas under Section 18 uses the phrase causes any grievous bodily harm'. Earlier the courts interpreted that the meaning of inflict' is much narrow as compared to cause' and the existence of assault or battery is essential. However, later in the case of Burstow, 1997 it has been established that both the terms inflict' and cause' bear similar meaning and the existence of battery or assault. This wide interpretation of the term has been subjected to criticism as it permits the imposition of liability on a person under the provisions of Section 20 in cases the defendant is not sufficiently at fault in order to be held liable for the said offence. Wound The term wound' has not been defined under the provisions of the Act. However, in the case of LCC v. Eisenhower court has given the term the meaning of breaking of skin. However, this meaning of the term is not conducive to the general understanding of the term. If we understand the term by the said meaning, then it would render an injury caused to an individual by a pinprick to be an offence under the provisions of Section 20 of the Act. Thus, there arises difficulty in interpreting the term. A lot is left in the hands of the judiciary in such a case. Outdated The Act has been enacted almost 150 years ago, and major issues arise when we intend to apply the provisions of the Act in the present times. Generally, legislations are enacted keeping in view the existing situations and circumstances of the society. The situations and circumstances prevailing at the time when the Act was enacted are very different from the ones prevailing at present. The Act must be updated in order to make it fit for dealing with the new circumstances prevailing in the society. The social issues and concerns that are relevant today are not reflected in the Act. Society has undergone major changes ever since the enactment of the Act. Today the judicial officers are required to interpret the laws with better understanding as the laws have to be applied to wholly new technologies cause there has been great changes in the mindset of the offender and modes of commission of the offences. For instance, the term bodily harm' has been used under Sections 18, 20 and 47 of t he Act. However, the aspect of the probability of psychiatric illness being caused to an individual as a consequence of fear was not included within the meaning of the term. However, at present this aspect is included under the definition of the term bodily harm and has evolved from case laws over the period of time. In the case of Ireland the defendant was accused of making innumerable phone calls to three women that made those women undergo psychiatric illness. The court convicted him under the provisions of Section 47 of the Act of having caused actual bodily harm to those three women. It was held by the House of Lords that silent phone calls amount to the offence of assault under the provisions of the Act. The court stated that when a silent phone call is being made, the victim might be under the fear that the caller would arrive at her place any moment. Such a feeling is conducive to the fear of the probability of instant personal violence. However, in an old case Tuberville v. Savage, the courts had laid down that when words are such that they do not indicate that violence may be caused, an action cannot be deemed to be an assault. In this case, the defendant by placing one of his hands on the sword said that if it would not have been assize time, he would not have taken such language. The court held that the said statement did not amount to assault because it is clear from the statement that person would not cause harm. This was the position earlier but now it is quite possible that person making the phone call is just outside the door of the victim, and there is high probability that the said person might cause harm to the victim. The way the offences under Section 18, 20 and 47 have been drafted in the said Act seem to be not accurate in the present times. They include the offences of the misdemeanor, felony and penal servitude but the law at present does not recognize these concepts. The maximum sentences for the offences have not been laid down under either Section 20 or Section 47. The Sections only provide imprisonment for five years. Again we may say that even though the seriousness of the offence of grievous bodily harm (laid down under Section 20 of the Act) is much more as compared to that of the offence of actual bodily harm (laid down under Section 47 of the Act), yet the sentences for committing both the offences is same. The offences laid down under Section 18 and 20 is quiet complicated and the Sections provide for various ways in which the offences may be committed. In case of both these offences, there appears to be a mismatch as to what the offender must have intended to do and what the offender must have actually done in order to constitute the offences. The consequence of such ambiguity is that the offender is many-a-times held liable for such results which he/ she had not foreseen or intended. Conclusion From the above discussion, we may conclude that the Act must be reformed so as to be able to provide for offences in a much fairer, clearer and logical manner. Moreover, if the laws are reformed, updated and made clear they would become accessible to legal professional and lay men alike. The complexity associated with the interpretation of the law would be reduced to a great extent. The law must be made fit to cover the new situations and also clear and cohesive. Thus, we mat say that the quoted statement of the Law Commission as regards non fatal offences against persons is very accurate and reform must be made to the Act so as to do away with the above discussed drawbacks. In order to ascertain the liability of Rohit and Umut in the given factual situation we must analyze the following legal principles; Liability for Criminal Damage in United Kingdom When damage is caused to property by an individual it is referred to as criminal damage. An individual who causes damage to property is dealt with under the provisions of Criminal Damage Act, 1971 (also referred to as the Act). Previously, criminal damage to property was dealt with in the United Kingdom under the Malicious Damages Act, 1861. Under the provisions of the Act a person is deemed to be guilty of criminal damage to property when he/ she intentionally cause damage to property which belongs to other individuals. However, in order to qualify as an offence, such act must not have been caused with lawful excuse. The offence of criminal damage comprises of the following elements; Damage Damage ought to have been caused to property The said property must be owned by some other individual The damage to the property must have been caused without any lawful excuse The damage must have been caused intentionally or recklessly Damage The Act does not provide for a definition of the term damage'. It is left to the courts to give meaning to the term depending upon the situation and circumstances that tend to vary from case to case. Generally the courts take into consideration the following factors in order to determine the causing of damage in a particular case; The damage caused to the property need not necessarily be permanent. Damage is said to have been caused even if somebody smears mud or paint on a property. Visibility of the damage caused is also not an essential condition. The fact that the damage caused is not visible but if as a consequence the property cannot be run properly, the courts would regard that damage has been caused to the property. Recklessness In order to establish a charge of criminal damage, the plaintiff has to prove that the actions of the plaintiff have been committed in a reckless manner. The Act lays down the definition of the term recklessness' under Section 1 of the Act. Section 1 of the Act provides that an individual is considered to have been acted in a reckless manner, as regards; A circumstance, if it is found that the individual concerned was aware of the risk involved; A consequence, if it is found that the individual concerned was aware of the risk before the occurrence. In the said circumstances, it must have not been reasonable for the individual concerned to take the risk. In the definition, the terms intention and recklessness have been used interchangeably. Establishment of one would mean the establishment of the other. Property Section 10 of the Act defines the term property'. Belonging To Another Individual A property is said to belong to an individual When the said individual has the authority to exercise control over the property or is in the custody of the said individual. When the said individual has a right to the exclusion of others in the said property When the individual owns a charge over the said property No Lawful Excuse In order to defend oneself from inflicting liability in an action for criminal damage to property, the individual concerned has to bring his/ her case under the provisions of Section 5 of the Act. Section 5 provides that The defendant must have been under the belief that the owner of the property has given consent for such action The defendant must have inflicted the harm under the apprehension that his/ her property would be damaged and the damage has been caused to protect the property from such damage. But the mode of protection adopted ought to be reasonable. Penalty If an individual is held guilty for causing criminal damage to property, then, Imprisonment for a maximum period of 5 years may be imposed upon the offender, in case, the valuation of the damage is less than 5,000. Imprisonment for a maximum period of ten years may be imposed upon the offender, in case, the valuation of the damage caused is over 5,000. Now applying the above legal principles to the given facts we may deduce the following; Criminal Liability of Rohit In the light of the given facts the actions of Rohit: resulted in damage to property belonging to the Blokes Bar , i.e., the property belonging to another individual the damage was caused to the property without any lawful excuse Rohit caused the damage intentionally, upon being requested to stop he threatened to cause more damage Rohit cannot justify his actions under the provisions of Section 5 of the Act Rohit's actions were also reckless Hence, it can be said that rohit is liable for causing criminal damage to the property of Blokes Bar. The courts would impose sentence upon him by relying on the estimate of the damage caused by his actions. Criminal Liability of Umut The bar counter was out on fire by Umut, purposely Umut caused damage to property belonging to another individual, i.e., the owner of Blokes Bar. The actions of Umut cannot be backed by any lawful excuse Hence, it can be said that Umut is liable for criminal damage to property under the provisions of the Act. Scopist Scopist Scopist By Maeve Maddox I received an email from a reader who is a scopist. The reader suspected that the title might be unfamiliar to me and kindly explained it: scopist/notereader for a court reporter. I was grateful because I’d never heard the word scopist before. Naturally I wanted to know more, so I looked the word up in the OED; it wasn’t there. Then I looked in Merriam-Webster Unabridged, but it wasn’t there either. Since it is a court-related occupation, I looked it up in a legal glossary and on a legal job site. Still nothing. Finally, a general Web search brought me to a definition in Wikipedia: A scopist edits the transcripts of official proceedings, created by court reporters. The word is recorded in the Ngram Viewer database, so I don’t understand why it isn’t in the OED; since the 1980s the word has been climbing in frequency of use. My only acquaintance with court transcripts is from my research into the life and career of Joan of Arc. The scribes at Joan’s trial copied down the proceedings, proofed them for omissions and errors, and then put the transcript in its final form. In Joan’s case the transcripts were falsified afterwards, but that was in the bad old Middle Ages. Apparently today’s court reporters aren’t expected to do the entire job themselves, probably because the courts are busier, and reporters don’t have time to correct their own work. These advertisements with an underlying flirtatiousness portrayed men as dependent on women who were stronger than them, and also appeared reassuring. While the woman is depicted as posing coquettishly, the tiny man pleads with her to allow him to have some of the brandy she holds in a bottle behind her back. Similarly, a robin in a top hat perches on a woman’s hand to drink the brandy she holds. Environmental degradation has been increasing, resulting to potential crises that need collective action coupled with the motivation for the good of the world community. The challenges that have led to the crises include; global warming, damaged ozone layer, water contamination, nuclear weapon proliferation and increased income inequalities within and among nations. Economic terrorism though illegal can be justified in several ways. There is a classical principle implying that, when markets are functioning properly, there are uncoordinated actions of self-interested groups or agents. This consequently result to an efficient outcome, where those who earn huge profits do so by making others lose severely . In circumstances where huge companies either privately owned or state-owned are involved in polluting the environment (for instance through emissions, chemical released into the water bodies) in the process of optimising their production, the societies that live around the degraded environment are the great losers. Illegal actions against such companies reduce efficient outcome. The companies cannot benefit hugely while the society loses through environmental degradation. Economic terrorism prevents â€Å"unhealthy† development. Many nations make efforts to become more developed, in an effort to improve the living standards of its people or citizens. Unfortunately, this may result to reduced living standards when the environmental consequences of this development outweigh the economic gains. Where legal channels of addressing this problem may fail, illegal actions may be the best option. Terrorism may be considered an effective way of preventing environmental degradation in countries where options are more limited for improving environmental quality. Expanding populations demand economic growth to support them. This may pressure such countries to undertake development activities that severely affect the environment. Limited options to prevent this type of development in such circumstances may result to economic terrorism against the country. Proliferation of nuclear weapons may give particular nations a sense of security and autonomy to pursue their own interests even when these interests affect the world community. This makes the countries so rigid, such that they cannot follow the set global guidelines to curb environment depletion as required. Some may therefore view economic terrorism against such nations as the only solution to stop them from further environmental devastation. In most cases, environmental degradation affects the weak in a society. Those who are not well equipped to take legal actions against the state for causing degradation, are usually convinced that they can still do the same through terrorism For instance, terrorism more often provides an advantage to the weak, especially when they are confronting the state The advantage is as a result of the terrorists’ use of secrecy and minimal resources needed for the attack. The market for the produced commodities is very crucial to the growth of any company. Lack of market for the commodities will mean huge losses for the producer. Where the producer fails to follow an environmental code, as required, legal action should be undertaken against them. Sometimes, this may fail. Environmental activists may have no other option other than sabotaging the market of the goods . For example, an activist minority group resulted to attacking anything and everyone associated with the entire production and distribution of Salmon fish that was found to have potential dangerous levels of cancer causing PCBs in the fish. Consumers were also targeted, which affected the market of the fish adversely (Key. W. 2004). Terrorist actions cause great costs for the industries that cause pollution or environmental degradation, compared to the costs they would incur if legal actions were taken against them. Result of illegal actions on their property will be taken very seriously, hence they will be more obliged to curb pollution to prevent future losses from such actions. Industries, companies or factories work very efficiently to protect against activities that may jeopardise their profits. Damage to property or commodities through terrorism are unacceptable to them. Legal actions that may be undertaken against them may be counteracted very easily. Environmental activists are very aware of this possibility. It will be very easy for them to undertake an action that is difficult for the institution to protect against- and that is economic terrorism. Economic terrorism enjoys more attention as compared to legal channels. â€Å"When a terrorist attack in one country involves victims, targets, institutions, governments, or citizens in another country terrorism assume a transnational character†(Sandler, T. 1997). It means a solution is likely to be sought, which will work towards curbing further environmental depletion. Finally, the fear of the developed countries that environmental degradation in the poorer countries may spill over to them may encourage trade war. This is whereby, these nations may impose ever more restrictive trade practices on the developing countries. This may be looked at as economic terrorism. These invisible tyrants are microorganisms. Underdeveloped countries, technologically advanced countries, and those in between are at the mercy of these microorganisms, which come in many forms - viruses, bacteria, fungi and parasites. The most dangerous of these forms is the virus. Some viruses, such as the common flu, are considered to have a fairly detrimental capacity. The flu can incapacitate a human for several weeks with various symptoms such as bodily soreness, fever, bronchial complications, and even pneumonia. But while these conditions can be painful and frightening, we are usually confident that proper medication and rest will take care of the matter.   Ã‚  Ã‚  Ã‚  Ã‚  However there is a much more severe and indiscriminate tyrant, with enormous corrupting influence, capable of infiltrating all of civilization. Scientifically, it is a submicroscopic pathogen consisting of a particle of nucleic acid, enclosed in proteins, and able to replicate only within a living cell. Socially, it is responsible for an enormous amount of chaos and fear in the world today, and pronounces the human fault of ignorance. Can it be considered to be a modern plague?   Ã‚  Ã‚  Ã‚  Ã‚  This complex and confusing king of all tyrants is called Human Immunodeficiency Virus, or HIV. HIV is a retrovirus. Retroviruses are commonly identified in many animal species, but HIV and its variants, such as HTLV I, HTLV II, HTLV III are among the rare retroviruses found in humans. It is transmitted through blood, semen, and vaginal secretions.   Ã‚  Ã‚  Ã‚  Ã‚  HIV is a retrovirus of the Lentivirus group and is the etiologic agent of Acquired Immune Deficiency Syndrome (AIDS). AIDS was first recognized as a disease syndrome in 1981; HIV was identified as its cause in 1984. AIDS is a life and death issue. To have the AIDS disease is at present a sentence of slow but inevitable death. There currently is neither a cure, nor an effective treatment, and no vaccine either.

What stocks are risky? What stocks in the portfolio that it has higher return? Many investors may use fundamental analysis to analysis financial data for answering above questions. In the last decade, some researches applied data mining techniques on financial market. Data mining is the process of automatically discovery useful information in large data repositories. It can be used to support a wide range of business intelligence applications such as customer profiling, targeted marketing, store layout. 2. Motivation In America, there are some research papers[2] about applying clustering technique on America financial market. For example, using Self-organizing map(SOM) to cluster stocks and financial ratio for fundamental analysis, using SOM to find the valuable stock. These all researches want to find the characteristic of the stocks. However, most these researches use SOM clustering technique, and focus on America financial market. It seems that few researches do similar thing in Hong Kong stock market. Moreover, these researches only want to find the characteristic of stocks. In real case, investors will not only purchase one stocks. They will construct a stock portfolio to eliminate the risk. So I want to apply similar approach on Hong Kong stock market and change the clustering technique to K-means, not SOM. And I not only want to cluster the stocks, but also the portfolio. I want to cluster many combinations of the portfolio as I can to find the characteristic of different combinations of the portfolio. I am interested in investment, and I study information technology in university. I want to combine two aspects for my final year project. And I believe this project is very useful for my future career. I have read relative books, papers for getting the basic idea and concept of portfolio and data mining. In this project, I use many technical skills, methods and knowledge learnt from City University of Hong Kong in the past three years. Phrygian Cap/Bonnet Rouge The Bonnet Rouge, also known as the Bonnet Phrygien / Phrygian Cap, was a red cap which began to be associated with the French Revolution in 1789. By 1791 it had become de rigueur for sans-culotte militants to wear one to show their loyalty and was widely used in propaganda. By 1792 it had been adopted by the government as an official symbol of the revolutionary state and has been resurrected at various moments of tension in French political history, right into the twentieth century. Design The Phrygian Cap has no brim and is soft and ‘limp’; it fits tightly around the head. Red versions became associated with the French Revolution. Sort of Origins In the early modern period of European history many works were written about life in ancient Rome and Greece, and in them appeared the Phrygian Cap. This was supposedly worn in the Anatolian region of Phrygian and developed into headwear of liberated slaves. Although the truth is confused and seems tenuous, the link between freedom from slavery and the Phrygian Cap was established in the early modern mind. Revolutionary Headwear Red Caps were soon used in France during moments of social unrest, and in 1675 there occurred a series of riots known to posterity as the Revolt of the Red Caps. What we don’t know is if the Liberty Cap was exported from these French tensions to the American Colonies, or whether it came back the other way, because red Liberty Caps were a part of American Revolutionary symbolism, from the Sons of Liberty to a seal of the US Senate. Either way, when a meeting of the Estates General in France in 1789 turned into one of the greatest revolutions in history the Phrygian Cap appeared.There are records showing the cap in use in 1789, but it really gained traction in 1790 and by 1791 was an essential symbol of the sans-culottes, whose legwear (after which they were named) and their headwear (the bonnet rouge) was a quasi-uniform showing the class and revolutionary fervor of working Parisians. The Goddess Liberty was shown wearing one, as was the symbol of the French nation Marianne, an d revolutionary soldiers wore them too. When Louis XVI was threatened in 1792 by a mob which broke into his residence they made him wear a cap, and when Louis was executed the cap only increased in importance, appearing pretty much everywhere that wanted to appear loyal. Revolutionary fervor (some might say madness) meant that by 1793 some politicians were made by law to wear one. Later Use However, after the Terror, the sans-culottes and the extremes of the revolution were out of favor with people who wanted a middle way, and the cap began to be replaced, partly to neuter opposition. This hasn’t stopped the Phrygian Cap reappearing: in the 1830 revolution and the rise of the July monarchy caps appeared, as they did during the revolution of 1848. The bonnet rouge remains an official symbol, used in France, and during recent times of tension in France, there have been news reports of Phrygian Caps appearing.

The ICT Project Essay Introduction: I have been given a task to find out a real end user for my project who is currently having problems with paper. I am brainstorming different types of techniques to improve the efficiency and quality of the paper based problem. I have found an end user for my project; it is one of my teachers in Sir John Cass, Mr Shah who is a key skills ICT teacher. His currently having a paper problem he needs to input details of individual student of their term report, his currently using a pen and a paper to input all the details such as the whole terms attendance, predicted grades etc. The type of software I will be using is Spreadsheet because it is one of the criteria in my project. Spreadsheet is an application used to input data into table graphs. This application will require basic computer (including input devices) and the spreadsheet application with a connected computer per unit. The way in which the spreadsheet will be constructed is a big factor when deciding its effectiveness and speed of input for example I do not want to overcomplicate the system. I will be using well known software called Microsoft Excel, which is ideal for the creation of tables and graphs as stated earlier. I in this case will be easy to use interface. Although the end user is not adept to the use of ICT I will be creating the system for a user with no ICT skills as this in a sense will speed up the input process further. Why not continue the old methods of registry and late entries: 1. All the work is written down so there are human errors such as spelling and when something like this is to happen you have to start over because on a formal piece of information there cannot be mistakes this can be time consuming. 2. Accuracy will be greatly increased with the user friendly interface which in addition to accuracy increases efficiency. 3. You may not able to make immediate electronic copies of information tables. 4. The special features available with Excel (spreadsheet) are no longer an option such as, immediate calculation, from entry, graphs and charts, etc. 5. Most of the surnames and first names are the same it can be difficult to find phone details, however with this system you can have this information automatically loaded with the name entry. Current System Mr Shah teaches year 7 to year 11 students for Key Skills ICT, the problems his currently facing is filling in individuals students records such as their term report, attendance record, working grade, everything on paper as it is a bit time consuming to find all the records of each students when filling in their report. Mr Shah is a very busy man as he is also the head of year of ICT key skills. The current system involves Mr Shah marking grades by using a pen and filling in term reports by manually and keeping records of individual students which involves writing everything on paper. Therefore I have stepped in to help him with his problems. I will be mainly focusing on year 11 as it is important for them because their about to face their exams. Problems with Current System: By reviewing Mr Shahs problem I have found out what the current common mistakes happened to be, they are: * The current system is inaccurate and most of the time he makes mistakes. For example, when she is working out percentage and grades for each student, she often makes calculation errors. * It is very time consuming, especially the calculation of percentages attained in marked worked and grades obtained overall. * As the names of students are not in order he finds it difficult to find the student to record a mark. * The report could easily get lost. * Also writing in individual names several times, which is time consuming. End User Requirement Statement of user requirements Mr Shah feels a computerized system will solve some of her current problems as she thinks she has some knowledge about Excel. She feels I will be able to create an effective, fast, and easy to use automated system to calculate her students marks for her, which will enable her to solve her problem. They are the following things she expects to get from a computerized system. Input * She wants the new system to enable her to make management decisions that she uses to support student, which need help, whether parents need contacting, whether other action is required e.g. Detention. * The system should automatically calculate the percentage and grades of each student. This system will therefore make her work more accurate and easy to use. * Mr Shah wants the new system to be able to enter student personal details, e.g. DOB, tutor group, surname, etc. * She wants the new system to be able to edit student personal details. Also she wants the system to able to delete student personal details if a student moves form her teaching group. Output * Mr Shah the new system to use colour coding when displaying grades of each student, e.g. Green for A*, Blue for A etc. * Mr Shah would like a report facility where she can select a student from a list and the report will show the students name, gender, from group, overall percentages mark, grade obtained and an automatic comment on progress. * The system should be able to produce chart, which will analysis student overall performance and also compare girls and boys performance. Processing * The system will put the names of student in alphabetical order. * Mr Shah wants the new system to automatically convert numerical marks to percentages. Storage * Mr Shah wants the new system to be able to store 30 students personal detail and also store results for up to 70 tests. * Finally, the new system should not be used by anyone else except Mr Shah, I will make sure the system is safe and I will make sure it has a security code. Backup protocols are a necessity in the event that the master copy is lost or destroyed. Backup up will be provided by an external hard drive, and the system will be backed up periodically, i.e. every week, or in special circumstances, for example, there is a significant in take of data into the system. Furthermore, the backup copy will be stored of site, so that if theres a natural disaster affecting the main site, the backup copy will remain. Plus, this method of backup can be described as differential backup, which practices a cumulative backup of changes from the last full backup , allowing a full system restore based upon the last full backup. Due to the non existent computer skills of the employees, an introduction into the use of computers is necessary. To accompany the basic skills they will acquire, I will need to develop a user manual which will provide detailed instructions in performing various tasks in the system as well as maintaining it, which is vital to its integrity and reliability. However, Victor has advised me to provide a manual of minimal size and contents in order to avoid confusion and enable the employees to read it swiftly, so they can get on with the job as soon as possible. Source Documents The source document that I have provided is a copy of marks book that Mr Shah uses to record her student marks. As you can see there is a lot of data to be inputted by hand. This is one of the problems that Mr Shah has. The calculations of total mark and overall have to make using calculator, which is time consuming. Objectives of the new system * The new system will perform the following tasks: * It should be able to identify students with poor performance by using a visual alert. * Ability to edit incorrect mark, so whenever Ms Gammon make an accidental mistake, she will have the ability to correct it. * The system should be able to produce average performance percentage of each student for her class. * It should have the ability to Edit and Delete students details if required, thorough the use of data forms. * Easy and clear to use. * It should automatically calculate percentages and grades from the inputted a student marks and maximum mark available for each test. * Cell, formulae protected to prevent accidental deletion. * It should automatically work out a students grade, based on overall percentage for all tests taken. * It should be able to generate an automated report for students showing student performance. * Password (security) on file access. * It should automatically colour code student grades. User Skill Level Mr Shah has used Microsoft Excel but does not use it to calculate percentage, and grades of her marks. She is an average user, which means she does not understand most of the advanced features. Such as Vlookup, IF Statement, Macros, etc. Project Constraints Mr Shah uses school standard PC that I will be using to calculate percentages and grades for the new system. It has a four processor, which has 512 MB of RAM and 30 GB hard disk. It has Microsoft software including the excel 2000. Mr Shah Pc has CD Rom, USB and floppy drive, which are also connected to school network. This will make my work to be easy when loading the new system onto her computer because I can store it on the CD or floppy disk and transfer the system. Ms Gammon has printer in her office, which will be used to print out reports of student performance Performance Criteria These are the performance criteria that are going to be used in the new system that Mr Shah asked for: * MR Shah will be able to correct mistakes that she might make during marking; this will make the system to be more neatly presented and pleasant. * It should be able to add and delete students if required. * The system will generate automated reports of each student by click of a button showing their performance that can be sent to parent. * It will be easy and clear to use. * The new system will produce an average performance percentage for each student. And also it will automatically convert numerical marks to percentages. * It should have protection to prevent accidental deletion of important formulae, numbers, table, chart and text. All the sheet and cells in the system must be protected with security to prevent these. * Graph and charts should be generated quickly and easily to compare boys and girls performance, All student and by form. * The new system will not take more than 4seconds to view performance and grades for each student. * The system will generate automated colour coding when displaying grades of each student. * The system will store 40 student personal details, and also store results for up to 50 tests. * Mr Shah will be able to select student from a list and the report will show the students name, gender, overall percentage mark, grade obtained and an automatic comment on progress. Design Choice of Software I think that Microsoft Excel is the best option of software because it has got many features such as: * It has advanced functionality such as pivot table, sort, forms, Vlookup, average, and write protection. This will make things more automated for the user. * Pivot: this will hold table for charts. This will not need to be seen by the user. When they select the chart that they require on the student summary sheet, the pivot table on the sheet will change to represent that choice. It will also used to summaries archive data for use in charts showing: 1. By gender 2. Form * Data entry form will be able to edit and delete student records. * Conditional formatting will allow automatic shading of cells to give visual message for highlighting grade attained and also table displaying student grades. * Macros can be used to perform complex tasks at the press of a single button. * It can perform complex calculation such as working out the grade for each student. * User Forms for controlling actions with macros using buttons. * Chart /Graph: can be used to display output of information such as averages, predicted grades etc. * The user wants the system to be as error-free as possible. Excels Validation facility will allow me to set up range validation to control data input when entering student personal details, overall mark etc. * Protections of cell so that user cannot accidentally delete information. Statement of Input, Processing Output requirement The input would be: Personal Details: First name Surname Gender Date of Birth Form Roll number Student marks: Assignment marks Maximum /minimum mark Grade Boundaries The Processing would be: Calculating the grades through a Vlookup to the grade boundaries table. Sorting, grouping and summarizing data with a pivot table. Calculate the average of total marks Using Vlookup work out a grade for the average. The output would be: Pivot Chart/Graph showing comparisons between gender, form-by-form and overall year group achievement. Give students their grades using report card. Table displaying student grades. Creating report for using student with performance. School letter, which would be sent out to parent using conditional formatting to highlighting grade attained. Data Set Because of Data Production Act, I cannot be able to use the real detail of Mr Shah Students. For that reason, I will create my own data set of example student details, which I will work with.

Martin Luther as Spiritual Icon for Adolf Hitler   Ã‚   The world has been plagued with the specter of anti-Semitism for many centuries. This hatred manifested itself in the frenzy of Nazism and the deaths of six million Jews, the Holocaust as it has come to be known. If someone were to reveal an eight step plan for the removal of Jews from European society, one would readily associate such a plan with Adolf Hitler. One would not, however, think also of Martin Luther, though he himself wrote an essay in 1543 entitled "Concerning the Jews and their Lies" outlining such a plan. This is not to suggest that Luther was akin to Hitler in action or deed. This does suggest that Luther, the spark of the Protestant Reformation and father of German nationalism, and his teachings had a profound impact on the anti-Semitic thinkers that were to follow (Prager 106). It is possible that Hitler and Luther shared a common ideological base.  Ã‚        Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Luther's attitude toward the Jews is puzzling. During the course of his theological writings Luther made a drastic transition from sympathy to hateful paranoia. Very early in his Protestant career Luther wrote an essay entitled "That Jesus Christ Was Born A Jew". In it he calls for tolerance, compassion, and peaceful conversion. "...they [Catholics] have dealt with the Jews as if they were dogs and not human beings" (Luther "That" 33). Luther believed that a purified Christianity, his Christianity, would attract Jews (Patterson 16). Jews could only truly be converted through a demonstration of the scriptural basis of Christianity. A Jew was a person of worth to Luther. Luther asked how Jews could improve his society (Luther "That" 34). Luther called into question those who advocated vi... ...was not constrained by Luther's sense of "merciful severity". Thus, it is unfair to say that Martin Luther was a direct cause of the Holocaust. Rather, Luther's anti-Semitic ideas and proposals provided a fertile soil from which the seeds of new even more horrific visions could germinate and grow into full bloom.    Works Cited Luther, Martin.
